NonToxicEarth is an online marketplace platform that enables independent third-party sellers (“Sellers”) to list and sell products to buyers (“Buyers”).

👉 NonToxicEarth is not the seller of products listed on the platform.
All transactions occur directly between Buyers and Sellers.

2. Eligibility

You must be:

  • At least 18 years old
  • Able to enter into a legally binding contract

By using the Website, you represent that you meet these requirements.

3. Account Registration

To access certain features, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your login credentials
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Buyer Terms

A. Orders & Payments

  • All payments are processed securely via Stripe and PayPal
  • Prices, taxes, and shipping fees are determined by Sellers
  • Orders are subject to Seller acceptance

B. Shipping & Fulfillment

  • Sellers are solely responsible for shipping, delivery, and fulfillment
  • NonToxicEarth does not guarantee delivery times or product availability

C. Returns & Refunds

  • Return and refund policies are set by individual Sellers
  • Buyers must contact Sellers directly for disputes
  • NonToxicEarth may assist but is not obligated to resolve disputes

5. Seller Terms

A. Seller Responsibilities

Sellers agree to:

  • Provide accurate product descriptions and pricing
  • Fulfill orders promptly and professionally
  • Comply with all applicable federal, state, and local laws
  • Handle buyer personal data in compliance with privacy laws

B. Prohibited Seller Conduct

Sellers may not:

  • Sell illegal, unsafe, or prohibited products
  • Misrepresent products or certifications
  • Use buyer information for marketing without consent
  • Circumvent platform fees or processes

C. Seller Data Use

Sellers receive limited buyer information solely to fulfill orders and provide customer service, as outlined in the Seller Privacy Addendum.

6. Fees & Payments to Sellers

  • Platform fees, commissions, and payout schedules are disclosed separately
  • Payment processing fees may apply
  • NonToxicEarth may withhold payouts for fraud prevention or compliance reasons

7. Intellectual Property

All Website content, including logos, text, graphics, and software, is owned by or licensed to NonToxicEarth and protected by intellectual property laws.

You may not copy, distribute, or exploit content without written permission.

8. User Content

Users may submit reviews, comments, and other content.

By submitting content, you grant NonToxicEarth a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the platform.

We reserve the right to remove content that violates these Terms.

  • PRODUCT DEFECTS OR SELLER MISCONDUCT
  • LOST PROFITS OR DATA

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO NONTOXICEARTH IN THE PRECEDING 12 MONTHS.

12. Indemnification

You agree to indemnify and hold harmless NonToxicEarth, its officers, directors, and employees from any claims arising from:

  • Your products or content (Sellers)
